3.1 Information We Collect from Artists
When an artist registers with Artibaa Gallery, we collect the following through our Artist Profile Form and onboarding process:
● Full legal name and preferred display/artist name
● Country of residence, city, and nationality
● Phone number and WhatsApp number
● Email address
● Website or portfolio URL and social media handles
● Artist biography and photograph (for public display on our website)
● Artistic style, medium, and years of practice
● Bank account details for payment purposes (account name, bank name, account number, SWIFT/IBAN code, and currency of account)
● Artwork details including title, medium, dimensions, year of creation, asking price, and high-resolution photographs
3.2 Information We Collect from Collectors
When a collector makes an offer or purchases an artwork through our platform, we collect:
● Full name
● Email address
● Shipping address
We do not store your payment card details. All payment transactions are processed securely through Stripe, our third-party payment processor. Please refer to Stripe's privacy policy at stripe.com/privacy for information on how Stripe handles your payment data.
3.3 Information Collected Automatically
When you visit www.artibaa.com, we and our third-party analytics partners may automatically collect certain information about your device and browsing behaviour, including:

● To operate the platform managing artist listings, processing collector offers, confirming sales, and coordinating the shipping and delivery of artworks
● To process payments facilitating payment to artists following a completed sale, via our payment partner Stripe
● To display artist profiles publishing artist biographies, photographs, and artwork details publicly on www.artibaa.com with the artist's consent
● To communicate with you responding to enquiries, sending sale updates, shipping notifications, and other transactional communications
● To send newsletters and marketing emails with your consent, we send newsletters and promotional updates to both artists and collectors via Hostinger Reach, our email marketing platform. You may unsubscribe at any time using the link in any email we send
● To improve our platform using analytics data from Google Analytics and Meta Pixel to understand user behaviour and improve our website and services
● To comply with legal obligations retaining records as required under New Zealand law

● With logistics partners: collector shipping addresses are shared with our appointed couriers and curators solely for the purpose of delivering purchased artworks
● With artists: we may share a collector's general delivery region (country or city) with the relevant artist for logistics planning purposes. We do not share a collector's full personal details with artists without necessity
● With legal or regulatory authorities: where required by law or to protect our legal rights
All third-party partners we work with are required to handle your information in accordance with applicable privacy laws.
7. International Data Transfers
Artibaa Limited operates across New Zealand and Africa. Your personal information may be stored or processed outside of New Zealand, including across various African countries where our artists are based, and on the servers of our third-party platforms (Google, Meta, Stripe, Hostinger). We take reasonable steps to ensure that any international transfer of your data is handled with an appropriate level of protection.
8. Data Retention
We retain your personal information for as long as is necessary to fulfil the purposes set out in this policy, or as required by law. Specifically:
● Artist information is retained for the duration of the Artist Listing Agreement and for a period of three (3) years following its termination
● Collector information is retained for up to five (5) years following a completed transaction for accounting and legal purposes
● Analytics data is retained in accordance with the default retention settings of Google Analytics and Meta
You may request deletion of your personal information at any time by contacting us at the details in Section 11.
9. Security
We take the security of your personal information seriously. We use reasonable technical and organisational measures to protect your data against unauthorised access, loss, or disclosure. Artist bank details and sensitive personal information are handled with particular care and are not shared beyond what is strictly necessary.
However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

Depending on your location and applicable law, you may have the following rights in relation to your personal information:
● Right of access: to request a copy of the personal information we hold about you
● Right to correction: to request that we correct inaccurate or incomplete information
